Scope of application

All our deliveries, services and offers are made exclusively on the basis of the following terms and conditions (GTC)

Conclusion of a contract / purchase agreement

All offers made by Phonobar represent a non-binding invitation to the customer to order goods. By placing an order by telephone, e-mail, fax or by post, the customer makes a binding offer to conclude a purchase contract. Phonobar is then authorised to accept this offer by delivery with invoicing or by sending an order confirmation. Delivery dates are only binding if they have been confirmed in writing

Shipping costs

Phonobar delivers worldwide. The shipping costs are added to each order individually. We endeavour to calculate the cheapest option in each case. Right of cancellation for EU consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession)

Cancellation policy/right of cancellation

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods. To exercise your right of cancellation, you must contact us (Phonobar, Susanne Krenzer, Kullavägen 6, 36076 Älghult, Sweden, Tel.0046/(0)481-63123, e-mail: info@phonobar.se) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail). To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired

Consequences of cancellation

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you dispatch the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods. If the goods cannot be returned normally by post due to their nature, but have to be sent by a forwarding agent, the costs are estimated at a maximum of around 300 euros for shipping within Germany and a maximum of around 1400 euros for shipping within Europe. Goods that cannot normally be returned by post can usually be recognised by the outward shipping costs of more than 35 euros (domestic) or more than 80 euros (international). You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality

Exclusion of the right of cancellation

The right of cancellation does not apply to contracts

  • for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer,
  • for the delivery of goods that can spoil quickly or whose expiry date would be quickly exceeded,
  • for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery,
  • for the delivery of goods if they have been inseparably mixed with other goods after delivery due to their nature,
  • for the supply of alcoholic beverages, the price of which was agreed upon conclusion of the contract, but which can be delivered at the earliest 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which the trader has no influence,
  • for the delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery,
  • for the supply of newspapers, periodicals, books or magazines with the exception of subscription contracts

 

Cancellation

Phonobar is entitled to withdraw from the contract if delivery is made significantly more difficult or impossible due to force majeure or other events unforeseeable at the time of conclusion of the contract for which it is not responsible. This applies in particular to technical faults or database errors. The seller can also withdraw from the contract if a calculation error has occurred (offer error). The buyer may withdraw from the contract within the scope of his right of cancellation

Transport damage

If goods are delivered with obvious transport damage, please complain about such defects to the deliverer as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you will help us to assert our own claims against the carrier or transport insurance company

Warranty and guarantee

We provide a 12-month guarantee on all our used appliances. The guarantee only applies to purely private use. The warranty claim expires if the appliance has been opened and/or modified. Excluded from the guarantee are wearing parts such as pickups, tubes, lamps, scratching potentiometers, etc. New appliances and exhibits usually have a longer guarantee period (usually 2 years) from the respective manufacturer. If an appliance is defective, we reserve the right to rectify the defect. We accept no liability for consequential or secondary damage. The statutory liability for defects applies. Information on any additional guarantees that may apply and their exact conditions can be found with the product

We do not use any cookies on this website that analyse your user behaviour. Your data will only be stored in connection with the processing of an order and used exclusively for order processing

Contract language

The language available for the conclusion of the contract is German and English

Information on the Battery Ordinance

As a retailer, we are obliged to inform our customers as follows in connection with the sale of batteries or rechargeable batteries in accordance with the Battery Ordinance: Please ensure that you take your used batteries to a municipal collection point or to your local retailer, as required by law (disposal in household waste is a violation of the Battery Ordinance). Disposal is free of charge. Of course, you can return batteries that you have received from us free of charge after use to us at the following address or send them back to us by post with sufficient postage: Phonobar

The chemical name of the pollutant can be found under the dustbin symbol - in the example "Cd" for cadmium. "Pb" stands for lead, "Hg" for mercury. You can also look up this information again in the documents accompanying the consignment or in the manufacturer's operating instructions. Further information on the Battery Ordinance can be found at the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety(www.bmu.de)

Retention of title

The delivered goods remain the property of Phonobar until full payment has been received

Place of jurisdiction

This contract and the entire legal relationship between the parties shall be governed exclusively by the laws of the Kingdom of Sweden, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). In the event that the customer does not have a place of residence or habitual abode in Sweden at the time the action is brought, and/or the customer is a commercial customer, Älghult shall be agreed as the place of jurisdiction

Severability clause

If individual provisions of these General Terms and Conditions and / or the contract supplemented by them are or become invalid, this shall not affect the validity of the other provisions and the contract and the General Terms and Conditions shall otherwise remain valid for both parties.
